On 7th May, the United States government withdrew a proposal notified in September 2020 under the Trump administration. The proposed rule made it mandatory for applicants, petitioners, sponsors, beneficiaries, and all individuals filing for or associated with a request or benefit for immigration or naturalization – including U.S. citizens – to appear for biometrics collection, regardless of their age.
The Department of Homeland Security (DHS) had also proposed to collect biometrics of illegal immigrants upon arrest, without regard to their age. Now, the DHS has explained that the proposed rule has been withdrawn following President Joe Biden’s Executive Order, which aims to restore faith in the USA’s legal immigration system.
A few days before this announcement, U.S. Citizenship and Immigration Services announced the suspension of biometrics requirements for the L-2, H-4, and specific non-immigrant visa categories starting 17th May. The move has been welcomed by USA visa experts, as well as several Indian-Americans who were affected by the biometrics requirement.
The DHS has maintained that it will still require people to submit biometrics when appropriate and is committed to fraud prevention, national security, program integrity, and identity management.
