Everything about the spousal sponsorship for Canada

Eligibility criteria for spousal sponsorship

  • The sponsor has to be a Canadian citizen or a permanent resident Canada
  • IRCC must be convinced that the sponsor and the person being sponsored fall under any of the three categories – Spouse/ Common-law partner/ Conjugal Partner
  • The sponsor must be at least 18 years of age and must prove that he or she is not receiving any social assistance except for disability reasons
  • The sponsor has to be financially stable to take care of the basic needs of the partner
  • If one is sponsoring as a Canadian citizen and lives outside Canada, then there arises a need to prove that the sponsor intends to live with the sponsored person in Canada

On the other hand, the person who is being sponsored must fulfill the below-mentioned eligibility under each category –

  • Spouse – Legally married and must be at least 18 years of age
  • Common-law partner – Lived together for at least 12 months continuously and must be 18 years old at least
  • Conjugal partner – Been in a relationship for at least one year, must be 18 years of age, and need to prove to IRCC that you could not live together or marry in your partner’s country

Process

To initiate the process of sponsoring your loved one to Canada, IRCC expects you to submit two applications together. One application is for spousal sponsorship, while the other application is for permanent residency of the person who is being sponsored.

The first step is to obtain an application package from IRCC. Then, you have to pay the application fees to IRCC online on its website. This fee includes the processing fee, right of permanent residence fee, and the biometrics fee. The last step is to mail the complete application to IRCC with all the documents and details required by the authorities.

The standard processing time taken by IRCC for the applications referring to spousal sponsorship is 12 months.
